FWCS - Foreign Worker Compensation Scheme 

The Foreign Workers Compensation Scheme (FWCS) scheme provides compensation arising from employment related accidents and diseases as provided under Section 26(2) of the Workmen's Compensation Act 1952 and also includes coverage for personal injuries sustained in an accident after working hours and repatriation expenses due to death or permanent disablement.

It is mandatory for every employer to insure all their foreign workers under FWCS, failing which, the penalty as stated under Section 26(6) of the Workmen's Compensation Act 1952, the employer upon conviction shall be liable to a fine not exceeding RM20,000 or imprisonment for a term not exceeding two years or both.

1. Workmen's Compensation (during-work hours) As per Workmen's Compensation Act 1952
 

a. Death

RM18,000 or 60 times monthly salary whichever is lower plus an additional RM7,000
Note: Funeral Expenses if workmen has no dependants - Actual amount or RM1,000 whichever is lower
 

b. Permanent total disability

RM23,000 or 60 times monthly salary whichever is lower
 

c. Permanent partial disability

As per the First Schedule of the Workmen's Compensation Act 1952
 

d. Temporary Total/Partial Disablement

As per Section 8(e) of the Workmen's Compensation Act 1952 - RM165 or 1/3 of monthly salary whichever is lower for the period of disablement or 5 years whichever is lower
 
 

e. Hospitalisation and Medical Expenses

As per Section 15(3) of the Workmen's Compensation Act 1952 - RM750
2. Repatriation Expenses Actual amount incurred or RM4,800 whichever is lower
3. Personal Accident (off-work hours)
 

a. Death

RM23,000
 

b. Permanent total disability

RM23,000
 
 

c.Permanent Partial Disablement

As provided for under Section 1 (c), (d) and (e) above 
 

d. Temporary Total/Partial Disablement
