Please read the terms below carefully. 

The Terms of Use stated herein (collectively, the “Terms of Use” or this “Agreement”) constitute an agreement between you and The Great Eastern Life Assurance Company Limited (“Great Eastern” or “we” or “us” or “our”). By accessing and/or using this Application (as defined below), you hereby expressly acknowledge and agree to be bound by the Terms of Use, including any future amendments, additions, replacements and modifications hereto as may from time to time be made by Great Eastern. If you do not agree to any of these Terms of Use, please do not access or continue using this Application.

In addition to these Terms of Use, you may be required to agree to other terms and conditions in respect of particular Contents or Services we may make available on or via this Platform from time to time. In the event and to the extent only of any conflict or inconsistency between the terms and conditions of any particular Content or Service and these Terms of Use, the terms and conditions for such Content and/or Service will prevail over these Terms of Use.

Great Eastern may amend these Terms of Use from time to time, without giving any notice to you and without giving any reason for doing so by posting an updated version of the Terms of Use on the Application. It is your responsibility to check them periodically for any changes. If you do not agree to the updated Terms of Use, you must immediately cease using the Application.

If you are under 18 years of age, you may only use this Platform with the consent of and under the supervision of your parent or legal guardian who shall be responsible for your use of this Platform.

 

1. Introduction to Our Application

The Rewards Programme (the "Application") is provided by Great Eastern. This Application is a mobile application aim to drive customer engagement.  This application provides easy access to redeem vouchers, rewards and privileges. The Application is accessible to both Great Eastern customers and non-Great Eastern customers. To use this Application, you must register an account with the Application by providing a valid email address and a password (herein refers to UPGREAT members “Members”).

 

2. Eligibility

Any member of the general public may download the Application and sign up for an account.

 

3. Using Our Application

3.1  The information and materials contained in this Application are provided on an "as is" and "as-available" basis without representation and/or warranty of any kind, either express or implied. In particular, no warranty or responsibility is assumed by Great Eastern and our related or holding companies regarding non-infringement, security, accuracy, completeness, adequacy, reasonableness, fitness for a purpose, or freedom from computer viruses in connection with the information and materials provided. Great Eastern and its related corporations do not accept any liability for any loss, damage, cost or other expense, whether wholly or partially, directly or indirectly, arising from any error, inaccuracy, or omission in relation to this Application to the extent that such liability is not excluded by law. 

 

4. Consent

4.1 By accessing and/or using this Application, you agree and consent to Great Eastern and its related corporations (collectively, the “Companies”), as well as the Companies’ authorised service providers and relevant third parties, collecting, using and/or disclosing your personal data for purposes reasonably required by the Companies to administer and/or manage your Account in this Application (such as awarding you with the Points which you have earned for participating in the challenges) and such other purposes as described in Great Eastern’s Privacy Statement (collectively, the “Purposes”) which is accessible from Great Eastern Singapore’s website, which you confirm you have read and understood.

4.2 Marketing Consent

In addition, by accessing and/or using this Application, you consent to the Companies as well as their respective representatives and agents collecting, using and disclosing your personal data in their records for the purposes of providing you updates and rewards about their products and services via:

·        phone; and

·        mail, email and other means of communication.

 

5. Third party Links

This Application may contain links to other third party websites owned and/or operated by third part(ies) who are not related or affiliated to Great Eastern (“Third Party Websites”). The Third Party Websites are not under the control and/or supervision of Great Eastern. By providing hyperlinks or connection to third parties' services/products/contents via this Application, Great Eastern is not responsible for the contents, and shall not be deemed to endorse, invite, recommend, approve, guarantee, or introduce any third parties or their services/products/contents, or have any form of cooperation with such third parties and websites. Great Eastern is not a party to any contractual arrangements entered into between you and the third party provider of services/products/contents unless otherwise expressly specified or agreed to by Great Eastern. Great Eastern shall have no obligations or liabilities whatsoever in relation to the offer(s), goods and/or service(s) (including, without limitation, their quality and supply) provided by third parties. 

 

6. Performance of the Application

6.1           Great Eastern makes no guarantee as to the reliability or other performance of the Application. The performance of the Application depends on various factors, including the functions, capacity and configuration of your mobile phones or access device, the speed of your internet connection, and the number of users assessing the systems which support the Application.

6.2            Great Eastern will use reasonable endeavours to generally make the Application available during its normal business hours. However, the availability of the Application depends on various third party service providers, and accordingly, Great Eastern does not represent, warrant or guarantee that:

a)            your use of the Application will be continuous, uninterrupted, secure or error-free; Any network connection difficulties occur;

b)            there will be no occurrence of network connection difficulties.

6.3            You acknowledge that the Application may not be available for use from time to time, and that you may be disconnected from your use of the Application at any time for any reason, including if:

a)            any network connection difficulties occur;

b)            the systems providing those services are unavailable for any reason (including system maintenance);

c)             you have breached any of these Terms of Use; or

d)            Great Eastern decides, in its sole discretion to suspend, block or terminate your access to the Application for any reason.

6.4           The information available through the Application is subject to updates from time to time. While Great Eastern aims to ensure that it is up-to-date, there may be delays, errors or omissions that could affect its currency or accuracy due to the nature of the Internet. Accordingly, Great Eastern does not represent or warrant that this Application will be available at all times and that access will not be interrupted, that any defects will be corrected, that there will be no delays, failures, errors or omissions or loss of transmitted information, that no viruses or other contaminating or destructive properties will be transmitted or that no damage will occur to your mobile phones or access device. Great Eastern is not liable for malfunctions in communications facilities not under its control that may affect the accuracy or timeliness of messages and transactions you send or receive. You have the sole responsibility for adequate protection of mobile phones/access device and backup of data by taking sensible and prudent actions.

 

7. Registration and Account Security

7.1 When using the Application, we expect you to help us maintain the security of your Account. You acknowledge and agree:

a)            to set up only one (1) account for your personal use as setting up multiple accounts is not allowed.

b)            you will not invent a false persona, but will use your real identity at all times on the Application.

c)             you will not impersonate another person or entity, or otherwise misrepresent your affiliation with another person or entity.

d)            to the fullest extent permitted under Singapore law, you shall keep all information obtained through this Application secure and confidential.

e)            you are solely responsible for maintaining the confidentiality of the information you hold for your Account, including your password, and for any activity that occurs under or through your Account as a result of your failure to keep this information private, secure and confidential. Great Eastern is not liable for any loss, damage, cost or other expense incurred by you due to any third party using your account or password as a result of your failure to keep your account information private, secure, and confidential.

f)             if you invent a false persona or misrepresent your real identity we reserve the right to disable, delete, or suspend your account.

g)            if we disable, delete, or suspend your account, you agree you will not create another account without our permission.

7.2           Great Eastern reserves the right, at its sole discretion, to do any of the following, at any time, without notice:

a)            amend, modify, add, delete, or revise in any way any information of this Application and/or these Terms of Use;

b)            determine, impose, and vary from time to time the scope and or any restrictions on the use of this Application to be made available;

c)             suspend or terminate operation of or access to the Application, or any portion of the Application, for any reason;

d)            expand, add, modify, reduce, remove, or change functionalities in the Application, or any portion of the Application;

e)            interrupt the operation of the Application, or any portion of the Application, as necessary to perform maintenance, error correction, or other changes; and

f)             purge your data from our Application at any time without notice, and you agree that we will not be liable for any loss alleged to result from purging, deletion, or failure to store your data.

7.3           Please note that by posting any information or content onto this Application or through instant messaging, you acknowledge that you are allowing Great Eastern and its related corporations to access and use that information, and to associate it with you. Please also take note that you should not post any information (be it texts, graphics, drawings, images, photographs, audio or video materials) that:

a)            could disable, overburden, or impair the proper working of the Application, including uploading viruses or other malicious code;

b)            may be unlawful, fraudulent, violent, abusive, obscene, profane, hateful, offensive, racist, discriminatory or otherwise objectionable or unreasonable;

c)             threaten, defame, bully, intimidate, or harass any person or organization or Great Eastern generally;

d)            are solicitations, advertisements, endorsements or misrepresentation of any kind, or unauthorized commercial communications (such as spam);

e)            infringe upon any entities' privacy and rights including intellectual property right or proprietary right of any person or organization;

f)              are off-topic; and

g)            contain anything else Great Eastern deems to be inappropriate.

You acknowledge and agree that Great Eastern shall have the right to modify, remove, or delete any posted data that in Great Eastern's sole opinion may be in breach of this term.

7.4            Great Eastern requires you to take the necessary precautionary measures to ensure that no unauthorised access is given to your Account. Therefore, you must not allow anyone other than yourself access to the Application. You must notify us immediately by email to upgreat-sg@greateasternlife.com if you suspect that your Account had been accessed by an unauthorised person.

7.5           Update & change of personal data

a)            Update, change or deletion of email is not allowed

b)            Change of mobile number can only be updated via the Great Eastern Customer Service.

c)             Your account will be deleted automatically due to inactivity if you do not log in at least once within 18 months of your last login.

d)            Any changes to your account will only be reflected in the Application and not in your Great Eastern policies/certificates.

 

8. Rewards, Challenges & Points

8.1          When using the Application, we expect the data you enter in the Application to be accurate and true to the best of your ability. You acknowledge and agree that:

a)           You will not knowingly falsify any data. 

b)           You agree that if you have falsified any data we reserve the right to:

              i.           modify, amend, update, or delete the falsified records;

              ii.           cancel any points/e-voucher earned through such means; and

              iii.           suspend, disable, or delete your Account in the case of repeated or egregious activity.

8.2           Members are responsible for the usage of all e-voucher(s) found in their “My Voucher” tab before the expiry date, failing which, the e-voucher shall be null; void and removed from the Member’s “My Voucher” tab and such e-vouchers shall not be replaced or extended.

 

9. Instant Offers

9.1          Members acknowledge and accept that the use of the e-voucher(s) under the Instant Offers section is subject to the terms and conditions imposed by the participating Merchants providing the relevant reward.

9.2          Instant offers e-voucher(s) in the form of digital vouchers; promo codes or barcodes:

a)           are denominated in Singapore Dollars, unless otherwise stated;

b)           must be used before the expiry date, failing which, the e-voucher shall be null; void and removed from the list and shall not be replaced or extended.

c)           where the e-voucher is in the form of a promo code or barcode, it shall not be shared or disclosed to other person(s).

d)           where prior reservations are required for the use of such e-voucher(s) with a Merchant, Member shall be responsible for making such prior reservations and paying the ancillary cost (if any) associated with the use of such e-voucher(s).

9.3          E-vouchers are not exchangeable for cash or other e-vouchers.

9.4          Members who have redeemed physical voucher(s), item(s) or prize(s) are not allowed to sell, or request for an exchange.

9.5          If the value of the goods and/or services purchased by the Member using the e-voucher exceeds the value stated therein, the Member shall be responsible for paying the difference to the Merchant.

9.6          E-voucher(s) that the Member is entitled to can be found in Member’s “My Voucher” tab and may be transferable as gifts (unless otherwise provided for) to third parties. However, the recipient must also be a Member in order to receive the e-voucher as a gift.

 

10. UPGREAT Points 

10.1        Members can earn UPGREAT points via the following channels

a)           Selected consumer promotions from Great Eastern

b)           Participate in GETGREAT activities

c)           Other  avenues that may be made available to Members from time to time

10.2        100 UPGREAT points (G100) is equivalent to S$1 (Singapore Dollar) and 1 GETGREAT point is equivalent 1 UPGREAT point.

10.3        UPGREAT points earned within a calendar year (Jan – Dec) will expire 2359 hours on 30 June of the following calendar year.

10.4        Great Eastern may from time to time, amend the validity period of the UPGREAT points and/or the UPGREAT points conversion rate without prior notice to the Members.

10.5        Expired UPGREAT points will automatically be forfeited without compensation to the Members.

10.6        If there is any mistake or error in the crediting or deduction of UPGREAT points, Great Eastern reserves the rights to credit or deduct the correct number of UPGREAT points from the Member’s account.

10.7        Members may use their UPGREAT points to redeem for e-vouchers from the points catalogue list through the Application and redemption will be made at the participating Merchant’s premises; websites or location as stated under “participating outlet” within the application.

10.8        To redeem an e-voucher(s) from the points catalogue, the Member must have in his or her account more than or at least the same amount of UPGREAT points as the amount of UPGREAT points required for redemption of such e-voucher(s). Upon successful redemption, the corresponding amount of UPGREAT points will be deducted from the Member’s account.

10.9        Great Eastern may in its discretion, apply different tiers of UPGREAT points required for the redemption of each e-voucher. For example, the UPGREAT points required for a Main user may differ from those required for a Basic user, or such other tiers or types of identification as may be implemented from time to time. 

10.10      Great Eastern may at its discretion, restrict the redemption of certain e-voucher(s) to selected Members.

10.11      E-voucher(s) may only be redeemed in full with UPGREAT points, partial redemptions are not allowed.

10.12      The list of available e-voucher(s) in the points catalogue and the number of UPGREAT points required for the redemption of the respective e-voucher shall be determined by Great Eastern and may be adjusted from time to time.

10.13      All e-voucher(s) redeemed using UPGREAT points are non-refundable and non-returnable. However, if there is a mistake or error in the amount of UPGREAT points required for the redemption, Great Eastern reserves the right to cancel the Member’s redemption request or process the Member’s redemption request and adjust the correct amount of UPGREAT points required for the redemption from the Member’s account.

10.14      All e-vouchers are subjected to availability and on a first-come-first served basis. In the event that the requested e-voucher is out of stock or unavailable for whatever reason, Great Eastern reserves the right to substitute the e-voucher with a voucher of similar value or remove the e-voucher from the catalogue.

10.15      All e-voucher(s) once redeemed (whether utilised or not) cannot be cancelled, returned, replaced, refunded or exchanged for cash, UPGREAT points or any other items. Any UPGREAT points used for successful redemption of an e-voucher shall not be reinstated under any other circumstances.

10.16      Members may use their UPGREAT points to participate in campaigns or contests (as and when applicable) available on the Application. The participation of Members in each campaign or contest shall be subjected to the specific terms & conditions governing such campaign or contest.

 

11. UPGREAT points conversion programme

11.1        To be eligible to perform conversion transactions in respect of UPGREAT points to the relevant Merchant’s loyalty points programme, or vice versa as listed in the points catalogue, Member must also be a member of the relevant Merchant’s loyalty programme, and membership in both Application and such selected loyalty programme must be valid from the time the conversion request is made on the Application until the conversion transaction is complete.

11.2        Members must have the requisite number of UPGREAT points or loyalty points of the relevant Merchant to perform the intended conversion transaction, throughout the entire conversion process until the conversion transaction is completed.

11.3        Great Eastern may in its sole and absolute discretion, apply different tiers of UPGREAT points required for conversion transactions to selected Members.

11.4        The list of loyalty points programme Merchants and the conversion rates shall be determined by Great Eastern and the loyalty points programme Merchants and such conversion rates may vary from time to time without prior notice. For the avoidance of doubt, Great Eastern and/or the loyalty points programme Merchants may, from time to time, amend the UPGREAT points and/or Merchant’s loyalty points required or received for each conversion transaction, or remove a loyalty points programme Merchant from the list of participating merchants without prior notice.

11.5        Member’s participation in this conversion programme is also subject to the terms and conditions stipulated by the respective Merchants’ loyalty programmes.

11.6        In the event of a mistake or error in the number of UPGREAT points deducted or issued for the conversion transaction, Great Eastern reserves the right to cancel the Member’s conversion request or process the Member’s conversion request and deduct or issue the correct number of UPGREAT points in respect of such conversion transaction from the Member’s account.

 

12.  Limit of Liability

12.1        By accessing or using this Application, you expressly agree that such access or use is at your own risk. Great Eastern assumes no responsibility and shall not be held liable for any loss, damage, cost or other expenses which you may incur as a result of any information or materials provided on this Application and/or your access to, or the use of, this Application. 

12.2        You acknowledge that you are fully aware and expressly agree that the use of this Application is subject to having all your relevant activities hereof monitored and recorded by Great Eastern. These activities include coaching conversations, data synced or logged with the Application and location (where permission is given by you). Emails and other communication sent to Great Eastern and/or the Application over the Internet cannot be guaranteed to be completely secure. Access to and use of your email address is at your own risk and subject to any terms and conditions applicable to such access/use. Great Eastern is not responsible for any damages incurred by you if you send an email/message to Great Eastern or if Great Eastern sends an email/message to you at your request, over the Internet. 

 

13. Indemnity

You agree to indemnify and must keep indemnified Great Eastern, its related companies and any holding companies from and against any and all damages, losses, liabilities, costs and expenses (including full legal costs on a solicitor-client basis) arising from or in connection with: (i) your access to or use of this Application; (ii) any other party’s access to or use of this Application using your account and/or password; or (iii) your breach of any of these Terms of Use; (iv) any other party’s breach of any of these Terms of Use where such party was able to access or use the Application using your Account and/or password.

 

14. Intellectual Property

All copyright and other intellectual property rights in this Application are proprietary to Great Eastern and its licensors. You shall not (and shall not attempt to):

a)           use, copy, reproduce, altered, adapt, broadcast, modify, stored in a retrieval system, create derivative works or use in any other way for public or commercial purposes any part of the Application;

b)          modify, reproduce, distribute, translate, transmit or tamper with any part of the Application;

c)           create derivate works of or from any part of the Application;

d)           permit or assist any person to engage in any act described in paragraphs 14(a) to 14(c) above. 

 

15. Ownership of Information

Any information (including data, questions, comments or suggestions but exclude personal data) that you transmit to us via this Application will be treated as non-confidential and non-proprietary and will become our property. Such information may be used by us for any purpose, including, but not limited to reproduction, disclosure, transmission, publication, broadcast and posting. Great Eastern may use any ideas, concepts, know-how or techniques contained in any communication you send to us via this Application for any purpose whatsoever, including developing and marketing products using such information. You therefore waive all applicable rights you may have in any information (other than personal data) you transmit to us via this Application for the purposes of this section of the Terms of Use. 

 

16. Personal Data Protection 

Any personal information submitted to Great Eastern via this Application will be subject to Great Eastern’s Privacy Statement (Singapore). 

 

17. Third party rights

A person who has not agreed to be bound by the Terms of Use shall have no right under the Contracts (Rights of Third Parties) Act (Cap.53B) to enforce any of the terms herein. 18. Contact Information

 

18. Inconsistency in wordings

In the event of any inconsistency and/or omission between the English language and other language versions of these Terms of Use, the English language version shall prevail. 

 

19. No Waiver

The failure of Great Eastern to enforce any right or provision in the Terms of Use shall not constitute a waiver of such right or provision.

 

20Severability

If any provision of the Terms of Use is held to be invalid or unenforceable, such provision shall be ineffective to the extent of such unenforceability or invalidity, without affecting the remaining provisions hereof.  

 

21. Governing Law and Jurisdiction

The above Terms of Use shall be governed and construed in all respects in accordance with the laws of Singapore. You and Great Eastern agree to submit to the exclusive jurisdiction of the Singapore courts.

24. Definitions

Unless the context otherwise requires, the following words shall have the following meanings:

“Account” means your account registered with the Application.

“Content” or “Contents” means any data and/or information that is available, accessible or stored in this Platform in an electronic form, including, without limitation, any information, advertisements, documents, text, files, images, sounds, moving images and videos.

“Basic” means a user who has signed up for an UPGREAT account

“Main” means a user who has signed up for an UPGREAT account and has verified themselves as a Great Eastern’s Policyholder

“Points” means UPGREAT points that Great Eastern may at its sole and absolute discretion permit you to earn when you participate in any challenges organised by Great Eastern and published in the Application, or for other initiatives or under any other program devised and/or managed by Great Eastern from time to time.

“Services” means any of the Internet-based, mobile based, interactive information services, software, content, or interactive tools that may be provided by Great Eastern.

 

25. Withdrawal of Marketing Consent

To use most aspects of this Application, you must register an account with this Application by providing an email and a password.

Any member of the general public may download the Application and sign up for an account.

3.  Using Our Application

3.1  Information and materials provided on this Application is general in nature. Neither Great Eastern nor Boundlss provides professional financial, medical, diagnosis or treatment advice. The information you may receive through this Application is not a substitute for the advice of a medical professional, and should not be relied upon when making medical decisions, or to diagnose or treat a medical or health condition. If you require medical advice or services, you should consult a medical professional.

3.2 While Great Eastern has taken reasonable care in providing such information and materials, they are not specific to your investment and/or health training objectives, financial and/or medical situation, or particular needs. No person should rely on the contents of any of the information, recommendations, products, or services through this Application without first obtaining advice from a qualified health professional. No person should act on any information, recommendations, products or services provided before they have formed their own opinion through investigation and research as to the suitability of the information, products, or services for their circumstances.

6.1  Great Eastern makes no guarantee as to the reliability or other performance of this Application. The performance of this Application depends on various factors, including the functions, capacity and configuration of your mobile phones or access device, the speed of your internet connection, and the number of users assessing the systems which support this Application.

6.2  Great Eastern will use reasonable endeavours to generally make this Application available during its normal business hours. However, the availability of this Application depends on various third party service providers, and accordingly, Great Eastern do not represent, warrant or guarantee that:

  1. your use of this Application will be continuous, uninterrupted, secure or error-free; Any network connection difficulties occur;
  2. there will be no occurrence of network connection difficulties.

6.3  You acknowledge that this Application may not be available for use from time to time, and that you may be disconnected from your use of this Application at any time for any reason, including if:

  1. any network connection difficulties occur;
  2. the systems providing those services are unavailable for any reason (including system maintenance);
  3. you have breached any of these Terms of Use; or
  4. Great Eastern decides, in its sole discretion to suspend, block or terminate your access to this Application for any reason.

6.4  The information available through this Application is subject to updates from time to time. While Great Eastern aims to ensure that it is up-to-date, there may be delays, errors or omissions that could affect its currency or accuracy due to the nature of the Internet. Accordingly, Great Eastern does not represent or warrant that this Application will be available at all times and that access will not be interrupted, that any defects will be corrected, that there will be no delays, failures, errors or omissions or loss of transmitted information, that no viruses or other contaminating or destructive properties will be transmitted or that no damage will occur to your mobile phones or access device. Great Eastern is not liable for malfunctions in communications facilities not under its control that may affect the accuracy or timeliness of messages and transactions you send or receive. You have the sole responsibility for adequate protection of mobile phones/access device and backup of data by taking sensible and prudent actions.

7.  Registration, Termination and Account Security

7.1  When using this Application, we expect you to help us maintain the security of your Account. You acknowledge and agree:

  1. to set up only one (1) account for your personal use as setting up multiple accounts (whether using false personas or otherwise) is not allowed.
  2. that each account may only be linked to one activity tracker, and that sharing of activity trackers across multiple accounts is not allowed.
  3. you will not invent a false persona, but will use your real identity at all times on this Application.
  4. you will not impersonate another person or entity, or otherwise misrepresent your affiliation with another person or entity.
  5. to the fullest extent permitted under Singapore law, you shall keep all information obtained through this Application secure and confidential.
  6. you are solely responsible for maintaining the confidentiality of the information you hold for your Account, including your password, and for any activity that occurs under or through your Account as a result of your failure to keep this information private, secure and confidential. Great Eastern is not liable for any loss, damage, cost or other expense incurred by you due to any third party using your account or password as a result of your failure to keep your account information private, secure, and confidential.
  7. if you invent a false persona or misrepresent your real identity we reserve the right to disable, delete, or suspend your account.
  8. if we disable, delete, or suspend your account, you agree you will not create another account without our permission.
7.2 Great Eastern reserves the right, at its sole discretion, to do any of the following, at any time, without notice:
 
      a. amend, modify, add, delete, or revise in any way any information of this Application and/or these Terms of Use;
      b. determine, impose, and vary from time to time the scope and/or any restrictions on the use of this Application to be made available;
      c. suspend or terminate operation of or access to this Application, or any portion of this Application, for any reason;
      d. expand, add, modify, reduce, remove, or change functionalities in this Application, or any portion of this Application;
      e. interrupt the operation of this Application, or any portion of this Application, as necessary to perform maintenance, error correction, or other changes; and
      f. purge your data from our Application at any time without notice, and you agree that we will not be liable for any loss alleged to result from purging, deletion, or failure to store your data.
 
7.3 Please note that by posting any information or content onto this Application or through instant messaging, you acknowledge that you are allowing Great Eastern and its related corporations to access and use that information, and to associate it with you. Please also take note that you should not post any information (be it texts, graphics, drawings, images, photographs, audio or video materials) that:
 
      a. could disable, overburden, or impair the proper working of this Application, including uploading viruses or other malicious code;
      b. may be unlawful, fraudulent, violent, abusive, obscene, profane, hateful, offensive, racist, discriminatory or otherwise objectionable or unreasonable;
      c. threaten, defame, bully, intimidate, or harass any person or organization or Great Eastern generally;
      d. are solicitations, advertisements, endorsements or misrepresentation of any kind, or unauthorized commercial communications (such as spam);
      e. infringe upon any entities' privacy and rights including intellectual property right or proprietary right of any person or organization;
      f. are off-topic; and
      g. contain anything else Great Eastern deems to be inappropriate.
 
You acknowledge and agree that Great Eastern shall have the right to modify, remove, or delete any posted data that in Great Eastern's sole opinion may be in breach of this term.
 
7.4 Great Eastern requires you to take the necessary precautionary measures to ensure that no unauthorised access is given to your Account. Therefore, you must not allow anyone other than yourself access to this Application. You must notify us immediately by email to GETGREAT-sg@greateasternlife.com if you suspect that your Account had been accessed by an unauthorised person.
 
7.5 Great Eastern reserves the right to suspend or terminate your Account at its sole discretion, including but not limited to upon the occurrence of one or more of the following:
      a. you breach any of these Terms of Use;
      b. you abuse the Application in any manner whatsoever; or
      c. you commit any fraud.
 
7.6 Update & change of personal data
 
      a. The email used to create your account may only be changed or updated by creating a new account and deleting the previous account
      b. Change of mobile number can only updated via the Great Eastern Customer Service.
      c. Your account will be automatically deleted due to inactivity if you do not log in at least once within 18 months of your last login.
      d. Any changes to your account will only be reflected in the Application and not in your Great Eastern policies/certificates.

8. Rewards, Challenges & Points

8.1  When using this Application, we expect the health, fitness, nutritional, and biometric data you enter in this Application to be accurate and true to the best of your knowledge, belief and ability. You acknowledge and agree that:

      a. You will not knowingly falsify any data, including but not limited to health metrics, fitness activities, nutritional data, sleep data, location data, or biometric data such as steps, weight, BMI, calories burned, or location.

      b. You agree that if you have falsified any data we shall have the right to, at our sole discretion, take any of the following steps:

            i. modify, amend, update, or delete the falsified records;

            ii. cancel any points earned through such falsified means; and/or

            iii. suspend, disable, or delete your Account without prior notice to you.

 

9. Limit of Liability

9.1 By accessing or using this Application, you expressly agree that such access or use is at your own risk. Great Eastern assumes no responsibility and shall not be held liable for any loss, damage, cost or other expenses which you may incur as a result of any information or materials provided on this Application and/or your access to, or the use of, this Application.

9.2 You acknowledge that you are fully aware and expressly agree that the use of this Application is subject to having all your relevant activities hereof monitored and recorded by Great Eastern. These activities include coaching conversations, data synced or logged with this Application and location (where permission is given you). Emails and other communication sent to Great Eastern and/or this Application over the Internet cannot be guaranteed to be completely secure. Access to and use of your email address is at your own risk and subject to any terms and conditions applicable to such access/use. Great Eastern is not responsible for any damages incurred by you if you send an email/message to Great Eastern or if Great Eastern sends an email/message to you at your request, over the Internet.

 

10. Indemnity

You agree to indemnify and must keep indemnified Great Eastern and Boundlss, its related companies and any holding companies from and against any and all damages, losses, liabilities, costs and expenses (including full legal costs on a solicitor-client basis) arising from or in connection with: (i) your access to or use of this Application (ii) any other party’s access to or use of this Application using your account and/or password; or (iii) your breach of any of these Terms of Use; (iv) any other party’s breach of any of these Terms of Use where such party was able to access or use this Application using your Account and/or password.

 

11.  Intellectual Property

All copyright and other intellectual property rights in this Application are proprietary to Great Eastern and its licensors. You shall not (and shall not attempt to):

  1. use, copy, reproduce, altered, adapt, broadcast, modify, stored in a retrieval system, create derivative works or use in any other way for public or commercial purposes any part of this Application;
  2. modify, reproduce, distribute, translate, transmit or tamper with any part of this Application;
  3. create derivate works of or from any part of this Application;
  4. permit or assist any person to engage in any act described in paragraphs 11(a) to 11(c) above.

12. Ownership of Information

Any information (including data, questions, comments or suggestions but exclude personal data) that you transmit to us via this Application will be treated as non-confidential and non-proprietary and will become our property. Such information may be used by us for any purpose, including, but not limited to reproduction, disclosure, transmission, publication, broadcast and posting. Great Eastern may use any ideas, concepts, know-how or techniques contained in any communication you send to us via this Application for any purpose whatsoever, including developing and marketing products using such information. You therefore waive all applicable rights you may have in any information (other than personal data) you transmit to us via this Application for the purposes of this section of the Terms of Use.

13. Personal Data Protection 

A person who has not agreed to be bound by the Terms of Use shall have no right under the Contracts (Rights of Third Parties) Act (Cap.53B) to enforce any of the terms herein.

15. Inconsistency in wordings

In the event of any inconsistency and/or omission between the English language and other language versions of these Terms of Use, the English language version shall prevail.

16. No Waiver

The failure of Great Eastern to enforce any right or provision in the Terms of Use shall not constitute a waiver of such right or provision.

17. Severability

If any provision of the Terms of Use is held to be invalid or unenforceable, such provision shall be ineffective to the extent of such unenforceability or invalidity, without affecting the remaining provisions hereof.

18. Governing Law and Jurisdiction

The above Term of Use shall be governed and construed in all respects in accordance with the laws of Singapore. You and Great Eastern agree to submit to the exclusive jurisdiction of the Singapore courts.

“Points” means reward points that Great Eastern may at its sole and absolute discretion permit you to earn when you participate in any challenges organised by Great Eastern and published in this Application, or for other initiatives or under any other program devised and/or managed by Great Eastern from time to time.

“Services” means any of the Internet-based, mobile based, interactive information services, software, content, or interactive tools that may be provided by Great Eastern.

GETGREAT Monthly Challenge Terms & Conditions

 

  1. When using the GETGREAT Platform, we expect the health, fitness, nutritional, and biometric data you enter in the Platform to be accurate and true to the best of your ability. You acknowledge and agree that:

    1. You will not knowingly falsify any data such as health metrics, fitness activities, nutritional data, sleep data, location data, or biometric data such as steps, weight, BMI, calories burned, or location.
    2. You agree that if you have falsified any data we reserve the right to:

      1. modify, amend, update, or delete the falsified records;
      2. cancel any points earned through such means; and
      3. suspend, disable, or delete your Account in the case of repeated or egregious activity.
         
  2. You must be 18 years or older at the point of registration. Eligible persons who are below 18 years of age must obtain parental consent before participating in the challenges within GETGREAT.

  3. Points are reset on the 1st of every month. Users who register 7 days before the 1st of the month would only have their points reset on the 1st of the following month.

  4. Upon the redemption of points, users will be notified via email within 1 working day and/or directed to UpGREAT Platform to access the e-voucher.

  5. Rewards are on a first-come-first-served, while stocks last basis.

  6. Great Eastern further reserves the right to modify and/or terminate these rewards at any time at its sole discretion without any further notice to participants.

  7. Great Eastern may vary these terms and conditions without notice, or discontinue or withdraw the Challenge at any time without any notice or liability to any party.

  11. Great Eastern shall not be liable for or in respect of any expenses, losses, costs damages, liabilities or other consequences of whatsoever nature (collectively “Losses”) suffered or incurred directly or indirectly by participants of the GetGREAT Monthly challenge howsoever caused or arising and without limiting the generality of the foregoing, whether by reason of or on account of any act or omission whether negligent or otherwise on the part of Great Eastern or its servants or agents, even if Great Eastern or its agents or employees are advised of the possibility of such Losses.

  12. Great Eastern reserves the right to disqualify and withdraw rewards from any person who is non-compliant to the terms and conditions of the GetGREAT Monthly Challenge at its sole discretion.

  13. Great Eastern’s decision on all matters relating to the GetGREAT Monthly Challenge is final and binding on all participants. Great Eastern will not entertain any queries with regard to any challenge results, and will not be obliged to provide the reason(s) for its awarding decision to a participant.
